Terms and Conditions
These Terms & Conditions apply to all services provided by Breakline Films ("we", "us", "our") to clients ("you", "the client"). By commissioning work from Breakline Films, you agree to the following terms unless otherwise agreed in writing.
1. Scope of Services
Breakline Films provides documentary-led film production services, primarily for online distribution. The scope of each project (including deliverables, timelines, locations, and usage) will be agreed in writing prior to commencement, typically via email, proposal, or contract.
Any work requested outside the agreed scope may be subject to additional fees and revised timelines.
2. Fees & Payment

All fees will be agreed in advance of production.

Unless otherwise stated, invoices are payable within 30 days of issue.

A deposit (typically 30–50%) may be required before production begins.

Final deliverables may be withheld until full payment is received.

Late payments may incur statutory interest and recovery costs in accordance with UK law.
3. Cancellations & Postponements
Client Cancellations

If a project is cancelled after pre-production has begun, all work completed to date will be chargeable.

If filming is cancelled or postponed within 7 days of the shoot date, you may be liable for:

crew fees
-
travel and accommodation costs
-
equipment hire
-
any other non-recoverable expenses

Force Majeure
Breakline Films will not be held liable for delays or cancellations caused by events beyond reasonable control, including but not limited to weather, illness, safety concerns, access restrictions, or environmental conditions. Where possible, projects will be rescheduled.
4. Creative Control & Editorial Judgement
Breakline Films retains creative and editorial control over the production process while working collaboratively with the client.
Reasonable feedback and revisions are included as agreed, provided they remain within the original creative direction and scope. Requests that significantly alter the agreed concept may be treated as additional work.
5. Deliverables & Revisions

Deliverables will be supplied in agreed formats suitable for online use.

Unless otherwise stated, the fee includes up to two rounds of reasonable revisions.

Additional revisions may be charged at an agreed-upon day or hourly rate.
6. Rights & Usage
Ownership
Unless otherwise agreed in writing:

The client is granted a licence to use the final films for their owned channels (including websites, YouTube, and organic social media).

Breakline Films retains copyright to all original footage and project files.
Extended Usage
Any use beyond owned channels — including paid advertising, broadcast, resale, or third-party licensing — must be agreed separately and may incur additional fees.
Self-Promotion
Breakline Films reserves the right to use completed work for self-promotional purposes, including showreels, website, festivals, talks, and social media, unless otherwise agreed in writing.
7. Credits
Where appropriate, Breakline Films may request a production credit such as:
“Produced by Breakline Films”
Credit placement and format will be agreed in advance where possible.
8. Expenses
Unless otherwise stated, quoted fees do not include:

travel

accommodation
-
specialist equipment
-
permits
-
access fees
-
third-party costs
These will be discussed and approved in advance where possible and invoiced accordingly.
9. Health, Safety & Risk
Breakline Films operates with due regard for health, safety, and environmental responsibility.
We reserve the right to modify or halt filming if conditions are deemed unsafe, including but not limited to weather, water conditions, wildlife sensitivity, or access issues. Safety decisions are final.
10. Confidentiality
Both parties agree to keep confidential any sensitive or proprietary information shared during the course of the project, unless disclosure is required by law or agreed in writing.
11. Liability
Breakline Films will take reasonable care in the delivery of services but shall not be liable for:

indirect or consequential losses

loss of profits or business opportunity

delays caused by factors outside our control
Our total liability shall not exceed the total fees paid for the relevant project.
12. Termination
Either party may terminate a project in writing if the other party commits a material breach of these Terms & Conditions and fails to remedy it within a reasonable period.
13. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
